PLEASE READ THIS AGREEMENT CAREFULLY. IT SETS FORTH THE LEGALLY BINDING TERMS AND CONDITIONS FOR YOUR USE OF TELO'S SITES, PRODUCTS AND SERVICES. 

Welcome to Telo. These Terms of Service ("Terms") govern your use of our website at telodesign.com and our Shopify™-powered store (collectively, the "Site"), owned and operated by Telo, LLC, a Minnesota-based limited liability company. 

By accessing or using the Site, placing an order, or purchasing Telo's products, you agree to be bound by these Terms. If you do not agree to these Terms, do not use Telo's Site or purchase Telo's products.

By accessing or using the Site, placing an order, or purchasing Telo's products, you acknowledge and accept Telo, LLC’s collection and use of your data in accordance with our Privacy Policy. 

1. About Us

Telo designs and develops innovative mobility products. We currently offer the Y-Cane through our Shopify™ store at telodesign.com. Telo, LLC is headquartered in Minnesota, USA.

2. Eligibility

By using the Site and placing an order, you represent that you are at least 18 years of age, have the legal capacity to enter into a binding agreement, and are not prohibited from purchasing Telo's products under applicable law.

3. Products & Orders

All product descriptions, pricing, and availability on the Site are subject to change without notice. 

We reserve the right to:

  • Limit quantities
  • Refuse or cancel orders
  • Correct pricing or listing errors

An order confirmation email does not constitute acceptance of your order. We reserve the right to accept or decline your order at any time prior to shipment. If we cancel your order, you will receive a full refund.

Prices are listed in USD and exclude applicable taxes and shipping, which are calculated at checkout.

Products are sold for personal use only. We reserve the right to limit or cancel orders that appear to be placed for resale, distribution, or commercial purposes without prior written consent.

4. Payment

All payments are processed securely through Shopify Payments™ and other approved providers. 

By placing an order, you represent that:

  • You are authorized to use the payment method
  • All information provided is accurate

You agree to pay all charges at the time of purchase, including taxes and shipping. Telo does not store full payment card details.

5. Shipping

We currently only ship to addresses within the United States. Shipping timeframes are estimates only and not guaranteed. Telo, LLC is not responsible for delays caused by carriers, customs, weather events, or other circumstances outside our control. 

Risk of loss and title transfer to you upon delivery to the carrier. If your order is lost or damaged in transit, please contact us at info@telodesign.com and we will work with the carrier to assist. Telo is not responsible for incorrect shipping addresses provided by the customer.

Shipping costs are calculated at checkout based on your location and selected shipping method. We reserve the right to update our shipping rates and carriers at any time.

Telo, LLC shall not be liable for any delay or failure to perform due to causes beyond our reasonable control, including but not limited to supply chain disruptions, transportation delays, labor shortages, natural disasters, or actions of government or third parties.

6. Returns & Refunds

Returns are subject to our Refund Policy, which is incorporated into these Terms by reference.

We reserve the right to deny returns or issue partial refunds for items that do not meet our return criteria or in cases of suspected abuse. Unauthorized returns may not be accepted.

7. Product Use & Safety Disclaimer

The Y-Cane is classified as a Class I medical device under U.S. Food and Drug Administration (FDA) regulations. Telo LLC is registered and the Y-Cane is listed with the FDA, as required.

As a Class I medical device, the Y-Cane is exempt from FDA premarket review, evaluation, and approval. It has not undergone clinical testing and does not make claims of therapeutic, rehabilitative, posture, stability, or fall-prevention benefits.

As with any mobility aid, use of the Y-Cane carries inherent risks, including but not limited to slips, trips, loss of balance, falls, serious injury, or death. Telo cannot guarantee individual results or outcomes and is not responsible for injuries or damages that may result from use.

Use the Y-Cane only as instructed. Do not use the Y-Cane if any part is cracked, bent, loose, missing, damaged, worn, or unstable. Stop using it right away if it feels unstable, unsafe, or uncomfortable.

The Y-Cane is a cane intended to provide minimal weight support while walking. It is not designed for full weight-bearing support or fall prevention. It is not suitable for all users, environments, or conditions. The Y-Cane may be less effective or unsafe on uneven terrain, stairs, wet, icy, slippery, loose, or hazardous surfaces. Users must exercise caution at all times and should not rely solely on the product for stability, balance, or support.

You are solely responsible for:

  • Proper assembly, adjustment, and maintenance of the product
  • Selecting appropriate environments and conditions for use
  • Using the product in accordance with all instructions and warnings
  • Determining whether the product is right for your physical needs

The Y-Cane is not intended to diagnose, treat, cure, or prevent any medical condition, nor should it be considered a substitute for prescribed or specialized mobility aids. Individuals with health concerns or medical conditions should consult a healthcare professional before use.

8. Assumption of Risk

By purchasing or using Telo’s products, you acknowledge and agree that the use of mobility aids involves inherent and unavoidable risks, including but not limited to slips, trips, loss of balance, falls, serious injury, or death.

You voluntarily and knowingly assume all such risks, whether known or unknown, including those arising from ordinary negligence, and accept full responsibility for any resulting injury, damage, or loss. 

You acknowledge that no mobility aid can eliminate all risks associated with movement. Use of the Y-Cane is at the sole risk of the user.

9. Indemnification

You agree to indemnify, defend, and hold harmless Telo, LLC and its affiliates, members, officers, directors, employees, predecessors, successors, agents, and assigns from and against any claims, demands, actions, suits, liabilities, damages, losses, settlements, judgments, costs, and expenses, including but not limited to reasonable attorneys’ fees and costs arising out of or related to:

  • Your use, misuse, or inability to use Telo’s products
  • Your violation of Telo’s full Terms of Service
  • Your violation of any applicable law or the rights of any third party
  • Any claims arising from personal injury, death, or property damage related to your use, misuse, or inability to use Telo’s products

Telo reserves the right to assume the exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate fully with Telo’s defense of such claim.

10. Intellectual Property

All content on this Site — including logos, product designs, images, text, trademarks, and trade dress — is the property of Telo, LLC and protected by applicable laws. You may not use, copy, reproduce, modify, or distribute any content without prior written permission.

Nothing in these Terms grants you any license or right to use any Telo trademark, logo, or brand feature without our express written consent.

11. User-Generated Content

Telo's Site may allow you to submit reviews, comments, or other content ("User Content"). By submitting User Content, you grant Telo, LLC a non-exclusive, royalty-free, perpetual, worldwide license to use, display, reproduce, and distribute your User Content in connection with operating and promoting the Site and Telo's products.

You represent that your User Content is accurate, does not infringe the rights of any third party, and does not contain unlawful, offensive, or harmful material. We reserve the right to remove any User Content at our discretion without notice.

You are solely responsible for any User Content you submit. Telo, LLC is not liable for User Content posted by others on the Site.

12. Prohibited Uses

You agree not to:

  • Use the Site for any illegal or unauthorized purpose.
  • Abuse, harass, threaten, or impersonate others on the Site.
  • Attempt to gain unauthorized access to our systems, accounts, or data.
  • Use automated tools (e.g., bots, scrapers, crawlers) to extract data from the Site without our written permission.
  • Submit false, misleading, or fraudulent orders or information.
  • Interfere with or disrupt the security, integrity, or performance of the Site.

We reserve the right to refuse service to anyone for any reason at any time.

13. Disclaimer of Warranties

To the fullest extent permitted by applicable law, the Site and all content and products are provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Telo, LLC does not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. Telo, LLC does not warrant that the product will meet your specific needs or prevent falls or injury.

14. Limitation of Liability

To the fullest extent permitted by applicable law, Telo, LLC and its affiliates, members, officers, directors, employees, predecessors, successors, agents, and assigns shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to damages related to personal injury, loss of mobility, or death, arising from your use, misuse, or inability to use the Site or Telo’s products, even if such damages were foreseeable or Telo has been advised of the possibility of such damages.

Telo’s total liability to you for any claim arising out of or relating to these Terms of Service or your use of the Site or Telo’s products shall not exceed the amount you paid for the product giving rise to the claim.

15. Accessibility

Telo, LLC is committed to making the Site accessible to all users, including those with disabilities. We strive to meet the Web Content Accessibility Guidelines (WCAG) 2.1 Level AA standards. If you experience any difficulty accessing content on Telo's Site, please contact us at info@telodesign.com or our mailing address found below and we will make reasonable efforts to accommodate your needs. While we strive to improve accessibility, we do not guarantee that the Site or Telo's products will be suitable for all users or all mobility or accessibility needs.

16. Third-Party Links & Services

Telo's Site is powered by Shopify™ and may contain links to third-party websites or services. These third-party sites have their own terms and privacy policies, which we encourage you to review. Telo, LLC is not responsible for the content, practices, or policies of any third-party sites or services.

17. Changes to Terms

We reserve the right to modify these Terms at any time. When we do, we will update the "Last updated" date at the top of this page. Continued use of the Site after any changes constitutes your acceptance of the new Terms. We encourage you to review these Terms periodically.

18. Error, Inaccuracies and Omissions

Occasionally there may be information on Telo's Site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information is inaccurate at any time without prior notice (including after you have submitted your order).

19. Severability  

In event that any provision of these Terms is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitting by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms, such determination shall not affect the validity and enforceability of any other portions of the Terms.

20. Termination

The obligations and liability of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes. These Terms are effective unless and until terminated by us.    

21. Entire Agreement

These Terms, our Privacy Policy and any other document we deem relevant constitute the sole and entire agreement between Telo and you with respect to the Site and supersede all prior and contemporaneous understandings, agreements, representations and warranties, both written and oral, with respect to Telo's Site.

22. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Minnesota, USA, without regard to its conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Minneapolis, Minnesota.

23. Your Agreement

By using this Site or purchasing or using Telo's products, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and voluntarily accept all risks associated with the use of Telo's products.
